Colorado JDF 1111: the 42-day deadline and monthly figures

Published October 28, 2026

In a Colorado divorce, legal separation, allocation of parental responsibilities or support case, each party gives the other a Sworn Financial Statement, form JDF 1111 (Form 35.2). This guide covers when it is due under the court rules, what goes with it, and how monthly figures are arrived at. It quotes C.R.C.P. 16.2(e)(2) as amended by Rule Change 2024(03), and the R10/25 form. It is general information, not legal advice; your court's case management order can add its own requirements.

42 days after service

C.R.C.P. 16.2(e)(2) says a party shall, without a formal discovery request, provide the Mandatory Disclosures (Form 35.1) and "a completed Sworn Financial Statement and (if applicable) Supporting Schedules ... to the other party within 42 days after service of a petition or a post decree motion involving financial issues." It adds that the parties shall exchange them "by the time of the initial status conference to the extent reasonably possible."

Two points follow from the wording. The clock runs from service of the petition, or of a post-decree motion about money, such as a request to modify child support. And it runs for both parties: the one who filed and the one who was served.

The 2024 opt-out

Rule Change 2024(03) added C.R.C.P. 16.2(e)(11). Parties may agree in writing to limit the exchange of financial disclosures to Sworn Financial Statements, but only if they affirm several conditions, among them that limiting disclosure will not create a substantial hardship and that "No party is pregnant, and the matter will not involve a determination of paternity, entry of a parenting plan, or an order of child support". Parties who do this file and serve an Affidavit in Support of Waiver of Mandatory Disclosures, Form 1372, within the same 42 days. The Sworn Financial Statement itself is still exchanged.

Have your statements as PDF, CSV or OFX? Financial Affidavit Numbers reads them in your browser, checks that each statement reconciles, and sorts the transactions into the form's own lines. You confirm every category and decide every flagged item. The worksheet gives each line's monthly average and the statement lines behind it:
WORKSHEET: JDF 1111, SECTION 3, MONTHLY EXPENSES
3C Groceries & Supplies $702.15
average monthly, 12 months, 163 transactions, schedule p. 4
3C Dining Out $187.15

3B Gas & Electricity $167.52

Monthly figures: what the form asks

Section 1 is headed "Convert annual, bi-monthly, and weekly amounts to monthly amounts." The form does not print the factors. The arithmetic of a 52-week year gives these:

PaidTo a monthExample
Weeklyx 52 ÷ 12$650 a week: $2,816.67
Every two weeksx 26 ÷ 12$1,400: $3,033.33
Twice a monthx 2$1,500: $3,000.00
Yearly÷ 12$1,080 car registration and tax: $90.00

"Bi-monthly" can mean twice a month or every other month; the form does not say which, so the table names each schedule. The first income line is gross, before taxes and deductions; the deductions go in section 2. Section 3E asks for insurance and registration/tax payments as "yearly amount(s) ÷12", the same idea for bills paid once a year.

Expenses from your statements

Section 3 asks for "regular monthly expenses ... that you pay on an on-going basis". For spending that changes from month to month, add up what your bank and card statements show for each line over a period, then divide by the months. For example, a year of grocery runs adding up to $8,425.80 is $702.15 a month on 3C "Groceries & Supplies". Counting a card payment as well as the card's purchases counts the same spending twice; see credit card payments versus purchases. Section 4 asks for the minimum monthly payment required on each unsecured debt, which each creditor's statement prints.

The statements you average are often the same ones the Mandatory Disclosures ask you to hand over, so the figures and the documents line up. For the form itself, line by line, see the JDF 1111 guide.

Financial Affidavit Numbers reads your bank and card statements in your browser and gives the monthly average for each JDF 1111 income and expense line over the months you choose, with every transaction behind each figure. You decide every category and copy the figures onto the form yourself; it does not fill in or exchange the statement.

Common questions

When is the Colorado sworn financial statement due?

C.R.C.P. 16.2(e)(2) says within 42 days after service of a petition or a post decree motion involving financial issues, and exchanged by the initial status conference to the extent reasonably possible.

Can parties in Colorado skip mandatory financial disclosures?

Since Rule Change 2024(03), parties may agree in writing to limit the exchange to Sworn Financial Statements if the conditions in C.R.C.P. 16.2(e)(11) are met, filing Form 1372 within 42 days. The Sworn Financial Statement is still exchanged.

How do I convert weekly pay to monthly for the JDF 1111?

The form says to convert weekly amounts to monthly without printing a factor. A 52-week year gives weekly pay x 52 ÷ 12; for $650 a week that is $2,816.67 a month.

Is JDF 1111 income gross or net?

The first income line is gross monthly income, before taxes and deductions. Taxes and other payroll deductions are listed in section 2.
